James M. Dorsey, pro se, was notified by an order of the National Labor Relations Board of its intention to order him to “take such affirmative action as may be just and proper under the circumstances,” including to return to his former employer his “letter of resignation,” to return to his former job or to reinstate and make whole the employee he discharged or discriminatorily refused to reinstate. Dorsey objected to the venue of the unfair labor practice proceeding in the district court in the county of his residence in the state of Georgia in which his employer was located. The Board, holding that it had jurisdiction over the matter, found venue to be appropriate in the Southern District of Georgia and assigned the matter to the Atlanta Division. The District Court held that the Board’s exercise of jurisdiction would be unlawful where venue was improper, and that the Board had failed to demonstrate that any harm to the respondent would be irreparable.
